These Terms and Conditions (“Terms”) govern your use of the OneControl mobile application, website, and related services (collectively, the “Service”), provided by Cargo Crew Rentals (PTY) LTD (“OneControl,” “we,” “us,” or “our”), a business operating from Johannesburg, Gauteng, South Africa.
By creating an account, installing our equipment, or using the Service, you agree to these Terms. If you do not agree, please do not use the Service.
1. The Service
OneControl provides a mobile application and supporting cloud infrastructure that allows you to monitor and control compatible security and automation equipment, including gate and garage motor controllers, electric fence controllers, and alarm system communicators, that we or an authorized installer have installed at your property.
The Service is offered on a free tier and a paid subscription tier (“Pro”). Features included in each tier are described within the app and may be updated from time to time.
2. Accounts
You must provide accurate information when creating an account and are responsible for maintaining the confidentiality of your login credentials. You are responsible for all activity that occurs under your account, including actions taken by anyone you grant shared access to.
Each account may only be signed in on one device at a time. This is a security measure, not a limitation on your ownership of the equipment — if you need to change devices, simply sign out on your old device first, or sign in on the new one and follow the prompts.
3. Subscriptions and Billing
Paid subscriptions renew automatically at the interval and price shown in the app at the time of purchase, unless cancelled beforehand. Prices are shown in South African Rand (ZAR) and may change with reasonable notice.
You can view, manage, and cancel your subscription from within the app. See our separate Refund Policy for details on refunds and cancellations.
4. Equipment and Installation
OneControl designs and supplies the hardware (gate motor controllers, alarm communicators, fence controllers, and related equipment) used with this Service. Hardware is sold wholesale to registered, independent security installers and distributors, who are responsible for installing, configuring, and supporting the equipment for their own customers.
Installers and distributors are independent businesses and are not employees, agents, or representatives of Cargo Crew Rental (PTY) LTD. Installation quality, workmanship, and any service arrangements between you and your installer are that installer’s responsibility, not ours.
If you are the end user of an installed system, you are responsible for:
– Ensuring your WiFi network and power supply meet the requirements communicated to you by your installer
– Keeping the app and your device’s operating system reasonably up to date
– Directing installation-related concerns to your installer in the first instance, and equipment/app concerns to us
5. IMPORTANT — Limitation of Liability and No Guarantee of Security Outcomes
**Please read this section carefully.**
OneControl is a monitoring and remote-control tool. It is not a substitute for, and does not guarantee, the physical security of your property, vehicles, or persons. Gates, electric fences, and alarm systems can fail due to causes outside our control, including but not limited to power outages, internet or WiFi outages, network congestion, third-party service interruptions (including cloud infrastructure and push notification delivery), equipment tampering, extreme weather, or user error.
To the fullest extent permitted by South African law:
– We do not guarantee that notifications will always be delivered, or delivered without delay.
– We do not guarantee uninterrupted or error-free operation of the app, connected equipment, or the underlying cloud service.
– We are not liable for any loss, theft, damage to property, personal injury, or other harm arising from the use, malfunction, or unavailability of the Service or connected equipment, except where such liability cannot be excluded under South African law (including the Consumer Protection Act, 68 of 2008).
– Nothing in these Terms limits liability for gross negligence, wilful misconduct, or death or personal injury caused by our proven negligence, where such limitation is not permitted by law.
You remain responsible for maintaining appropriate physical security practices, insurance, and vigilance regardless of your use of the Service.
6. Acceptable Use
You agree not to:
– Use the Service for any unlawful purpose
– Attempt to gain unauthorized access to any account, device, or system that is not yours
– Interfere with or disrupt the Service or its infrastructure
– Reverse engineer, decompile, or attempt to extract the source code of the app, except where permitted by law
7. Intellectual Property
The OneControl app, branding, and associated materials are the property ofCargo Crew Rentals (PTY) LTD or its licensors. You are granted a limited, non-exclusive, non-transferable license to use the app for its intended purpose. All other rights are reserved.
8. Third-Party Services
The Service relies on third-party infrastructure (including cloud hosting and push notification providers) to function. We are not responsible for outages or failures originating from these third-party providers, though we will make reasonable efforts to maintain service continuity.
9. Termination
We may suspend or terminate your access to the Service if you breach these Terms, or for any reason with reasonable notice where practical. You may stop using the Service and close your account at any time by contacting us.
10. Changes to These Terms
We may update these Terms from time to time. Material changes will be communicated through the app or by email where possible. Continued use of the Service after changes take effect constitutes acceptance of the updated Terms.
11. Governing Law
These Terms are governed by the laws of the Republic of South Africa. Any disputes will be subject to the jurisdiction of the South African courts.
